May security of tenure ang empleyado.
- Magpadala ng neutral work updates. Halimbawa: “Completed A and B today. Pending C because approval is needed. Please confirm the next priority.”
| Record | Ilagay o itabi | Bakit mahalaga |
|---|---|---|
| Work output | Submission dates, acknowledgment, approved work, relevant evaluations | Pang-answer sa claim na late, absent, o underperforming |
| Instructions at resources | Orders, changing targets, access problems, requests for training | Context ng performance at compliance |
| Notices | NTE, warnings, PIP, suspension/transfer memo, termination letter, envelopes/emails | Grounds, dates, at procedure |
| Pay at attendance | Payslips, bank credits, schedules, time logs, leave approvals | Bawas sahod, nonpayment, o disputed absence |
| Messages | Full relevant thread, sender details, dates, original email/export kung lawfully available | Context, authenticity, at pressure to resign |
| Complaints | HR/owner/CODI complaint, proof of receipt, response, follow-up | Employer knowledge at ginawa o hindi ginawang action |
| Health/safety impact | Consultation dates, medical records, incident/police reports kung relevant | Actual harm at need for protective measures |
| Witnesses | Pangalan, safe contact if willing, ano mismo ang personally nakita/narinig | Independent corroboration |
| Employer-controlled records | CCTV location/date/time, timekeeping entries, meeting records | Para makapag-request ng preservation bago ma-overwrite |
Simple incident entry: “23 Oct 2026, 2:15 p.m., team meeting. Sinabi ni [position/name] ang [words]. Present sina [witnesses]. Task submitted at [time], proof E-03. Nag-email ako sa HR at [time], proof E-04.”
Para sa just-cause termination, DOLE Department Order 147-15 requires specific grounds at detailed facts sa first notice, at reasonable time to explain—at least five calendar days from receipt. Dapat may meaningful opportunity to defend yourself at written decision notice kung itutuloy ang dismissal. Formal hearing/conference becomes mandatory kapag requested in writing, may substantial evidentiary disputes, required ng company rule/practice, o may similar circumstances na nangangailangan nito. [2]
Natanggap ko ang Notice to Explain noong [date/time].
Nananatili akong willing to perform lawful duties, subject sa aking safety at documented medical needs.
Sa meetings, request a representative o witness where appropriate at written minutes.
Ang voluntary at reasonable settlement can bind you.
Sa Torreda v. Investment and Capital Corporation of the Philippines, G.R.
9. Kung sinabing huwag pumasok, na-lock out, o sinuspinde
Written follow-up:
Naka-schedule akong magtrabaho noong [date/time], pero [specific access restriction/instruction].
Absence alone does not establish abandonment; may required intent to sever the relationship. Gayunman, huwag basta mawala o balewalain ang return-to-work notice. Ipasuri ang instruction at mag-respond nang maayos. [3]
Preventive suspension is different from a disciplinary penalty. It requires a serious and imminent threat to life or property of the employer/co-workers; ordinarily, hindi ito puwedeng lumampas ng 30 days. Pagkatapos nito, reinstate sa former/substantially equivalent position, o bayaran ang wages and benefits during a lawful extension. [8]
Ang Safe Spaces Act can cover qualifying workplace conduct between peers at online communications din. [4–5]
Humingi ng independent complaint mechanism/CODI, impartial investigation, at protection from retaliation. Sa RA 11313 workplace mechanism, required ang investigation and decision within ten days or less of receipt, due process, at confidentiality to the greatest extent possible.
RA 9262 has relationship requirements; ipasuri kung may qualifying relationship at acts. [13]
Sa Article 300, formerly Article 285, maaaring mag-terminate ang employee without notice for qualifying serious insult sa honor/person, inhuman and unbearable treatment, crime/offense laban sa employee o immediate family by employer/representative, at analogous causes.
May stress and immediate-resignation guide.
13. Saan lalapit: HR, SEnA, DOLE, NLRC, o police?
| Route | Para saan | Ano ang ihahanda |
|---|---|---|
| HR/higher management/union/CBA grievance | Workplace correction, representation, internal investigation | Factual complaint, chronology, relevant attachments, requested remedy |
| CODI/independent mechanism | Qualifying workplace sexual-harassment complaint | Specific acts, messages/witnesses, protection and confidentiality requests |
| SEnA Request for Assistance (RFA) | Conciliation-mediation para subukang maresolba ang labor dispute; puwede habang employed ka pa | Employer name/address, contact details, employment facts, issue, desired resolution, available records |
| DOLE Regional/Provincial Office | Labor assistance; referral; applicable labor-standards/compliance concerns | Pay/time records, employer details, facts ng alleged violation |
| NLRC Labor Arbiter | Illegal/constructive-dismissal cases and other claims within jurisdiction, subject to applicable conciliation/referral rules | Complaint facts, evidence file, SEnA referral/endorsement where required, requested relief |
| Police/prosecutor | Violence, criminal threats, sexual offenses, o ibang possible crime | Available evidence, witnesses, medical/incident records; safety first |
| Philippine labor lawyer, union legal service, PAO/legal aid | Assessment ng strategy, deadlines, documents, at representation | Chronology, actual notices, signed documents; PAO/legal aid subject to eligibility and acceptance |
Kung proven ang illegal o constructive dismissal: maaaring reinstatement without loss of seniority at full backwages. Separation pay in lieu of reinstatement may apply kung legally justified na hindi na feasible ang reinstatement; hindi ito automatic employee choice. May sariling requirements ang unpaid wages/benefits, damages, at attorney’s fees. [1,3]
15. May deadlines ba?
Oo. Generally four years from accrual ang illegal-dismissal action; generally three years ang ordinary employment money claims. Ang backwages/damages arising from illegal dismissal are not simply treated as ordinary three-year wage claims. Ito ang distinction sa Arriola v. Pilipino Star Ngayon. [9]
16. Checklist sa susunod na 24–48 oras
- [ ] Safe ba akong pumasok, bumiyahe, at makipag-meeting?
- [ ] May one-page chronology at evidence index ba ako?
- [ ] May deadline ba sa NTE, meeting, return-to-work notice, o signed agreement?
- [ ] May specific remedy ba akong hinihingi: stay safely, independent review, pay correction, o negotiated exit?
17. Mga Madalas Itanong (FAQs)
Kailangan bang mag-resign bago magreklamo?
Puwede bang kasuhan kahit walang termination letter?
Posible. Actual exclusion from work o constructive-dismissal circumstances can matter.
Ordinary bullying, sex-based conduct, sexual harassment, at violence can require different legal routes. [4–5]
Government employee, kasambahay, OFW, o freelancer ako—pareho ba ito?
Private-sector employment ang main scope ng guide. Government civil-service employment, kasambahay, at overseas work have special rules/routes.
