Remote Work and Privacy

Philippine Labor Law Topic Hub

Remote Work and Privacy covers the rules for working away from the office, how far an employer may monitor employees and handle their personal data, and how existing labor law applies when software or AI is used to hire, score or let people go.

What This Topic Covers

Three sets of rules meet here. The Telecommuting Act (Republic Act No. 11165) governs work-from-home arrangements. The Data Privacy Act of 2012 (Republic Act No. 10173), enforced by the National Privacy Commission, governs what employers do with employee data. And the Labor Code’s rules on just and authorized causes and due process still apply when a decision is made with the help of an algorithm.
