These Terms of Service govern access to and use of LaborCode.ph, including its articles, glossary, search tools, forms, downloads and other website features. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
1. About LaborCode.ph
LaborCode.ph is an independent educational and general-information website about Philippine labor law. It is not a government website, law firm, legal clinic or official dispute-resolution body. References to “LaborCode.ph,” “we,” “us” or “our” include the website’s operators, editors, authors, contributors and service providers acting for the website.
2. No legal advice or professional relationship
Website content is provided for general education, research and informational use only. It is not legal advice, a legal opinion, case evaluation, representation or a substitute for advice from a qualified Philippine lawyer or the appropriate government agency.
Accessing the website, using a calculator or template, sending a message, submitting a correction or communicating with the editorial team does not create an attorney-client, consultant-client, fiduciary or other professional relationship. Do not send information that you expect to be protected by attorney-client privilege.
3. Official sources and changing law
Labor laws, regulations, wage orders, administrative issuances, government procedures and court interpretations may change. We aim to use reliable and traceable sources, but we do not guarantee that every page is complete, error-free or current at the time it is read.
When website content differs from an official law, regulation, issuance, court decision or government instruction, the official source controls. Publication dates, review dates and citations do not guarantee that no later development has occurred.
4. Your responsibility
You are responsible for evaluating whether information applies to your facts, preserving evidence, checking deadlines and obtaining professional or official assistance when needed. Do not delay action on an urgent matter because of information found on this website.
Calculators, examples, checklists, templates and sample wording are general tools. Results may change based on employment status, wage orders, payroll practices, collective bargaining agreements, contracts, evidence, jurisdiction and later legal developments.
5. Permitted use
You may access, read, link to and make reasonable personal, educational or internal-business use of the website. You may quote brief portions with clear attribution and a link to the original LaborCode.ph page, subject to applicable law.
6. Prohibited use
You must not use the website to violate law, infringe rights, impersonate another person, distribute malware, send spam, harvest personal data, interfere with website operation, bypass access controls, probe systems outside the published Security Policy, submit knowingly false or unlawful material, or use automated requests at a volume that degrades service.
Search engines and legitimate research tools may index publicly available pages in a reasonable manner. Scraping, copying or republishing substantial portions of the website to create a substitute service, dataset or commercial publication requires prior written permission unless allowed by law.
7. Intellectual property
Unless otherwise stated, original website text, structure, branding, graphics, compilations and editorial materials are owned by or licensed to LaborCode.ph and are protected by applicable intellectual-property laws. Philippine laws, official issuances and court decisions remain subject to their own legal status and source rules.
No trademark, logo, design or substantial content may be used in a way that suggests sponsorship, endorsement, affiliation or official government status without written permission.
8. User submissions
If you submit a correction, source, comment, suggestion, inquiry or other material, you represent that you have the right to submit it and that it is accurate to the best of your knowledge. Do not submit confidential employer records, passwords, government identification numbers, financial details, medical records or sensitive personal data unless a secure method has been specifically agreed.
You retain ownership of material you submit. You grant LaborCode.ph a non-exclusive, worldwide, royalty-free license to review, reproduce, adapt and use the submission for editorial review, corrections, source verification, publication and website improvement. We may decline, remove, redact or not respond to a submission.
9. Privacy and cookies
Personal data is handled according to our Privacy Policy. Information about browser storage and analytics technologies appears in our Cookies Policy.
10. Third-party links and services
The website may link to government agencies, courts, publishers, technology providers and other third parties. A link does not mean that LaborCode.ph controls, guarantees or endorses the third party, its security, availability, content or privacy practices. Third-party terms and policies apply when you use their services.
11. Website availability and security
We may change, suspend, restrict or discontinue any feature or content without notice. We do not guarantee uninterrupted access, compatibility with every device, preservation of every submission or freedom from harmful components. Please review our Security Policy before reporting or testing a possible vulnerability.
12. Disclaimer of warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without express or implied warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, availability or outcome. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of liability
To the fullest extent permitted by law, LaborCode.ph and its operators, editors, authors, contributors and service providers will not be liable for indirect, incidental, special, consequential or exemplary loss arising from use of, inability to use or reliance on the website, including missed deadlines, employment decisions, lost income, lost data or third-party conduct.
Where liability cannot legally be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability for fraud, willful misconduct or any liability that the law does not allow to be excluded or limited.
14. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses and reasonable costs arising from your unlawful use of the website, your violation of these Terms or your infringement of another person’s rights. This provision does not apply where prohibited by law.
15. Enforcement and termination
We may restrict access, remove submissions, preserve evidence or cooperate with lawful requests when we reasonably believe these Terms, website security or applicable law have been violated. We may take protective action without prior notice where necessary.
16. Changes to these Terms
We may revise these Terms as the website, services or law change. The updated version will be posted on this page with a new last-updated date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
17. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without prejudice to mandatory rights that apply to you. Disputes that cannot be resolved informally are subject to the jurisdiction of competent Philippine courts or authorities.
18. General provisions
If a provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Cookies Policy, Security Policy and Legal Disclaimer, form the website-use agreement.
19. Contact
Questions about these Terms may be submitted through the LaborCode.ph contact page. For case-specific legal advice, contact a qualified lawyer or the appropriate government agency.
