This Privacy Policy explains how LaborCode.ph collects, uses, stores, shares and protects personal data when you visit the website, use its search and tools, submit a correction or source, contact the editorial team or otherwise interact with the site.
1. Personal information controller
LaborCode.ph acts as the personal information controller for personal data collected through this website. The website’s operators and editorial team are identified on the About page. Privacy requests may be submitted through the Contact page using the Privacy or Security Concern option.
2. Scope
This Policy applies to LaborCode.ph and forms, tools and services hosted under the LaborCode.ph domain. It does not control third-party websites, government portals, embedded services or external platforms linked from the website.
3. Personal data we may collect
Information you provide
We may collect your name, email address, organization, subject, message, page URL, correction details, source links and other information you voluntarily provide through contact, correction, editorial, privacy or security submissions.
If comments, account features or uploads are enabled, we may also collect the information shown in the relevant form, associated metadata, IP address and browser user-agent information for moderation, authentication, security and spam prevention.
Information collected automatically
When you visit the website, hosting, security, analytics and performance systems may collect IP address, device and browser type, operating system, referring page, requested URLs, dates and times, approximate location derived from IP address, cookie or device identifiers, interaction events, error reports and security logs.
Information from service providers
We may receive aggregated or account-level reports from hosting, analytics, security, anti-spam, email, search and performance providers. The information available depends on the provider and its settings.
4. Sensitive and confidential information
LaborCode.ph is not a confidential legal-service channel. Do not submit passwords, government identification numbers, bank or payment details, medical records, complete personnel files, confidential company documents, privileged communications or full case records.
If sensitive personal information is submitted without request, we may restrict access, redact, delete or retain only what is reasonably necessary for security, legal compliance or the purpose for which it was sent.
5. Purposes of processing
We process personal data to operate and secure the website; respond to inquiries; review corrections and official sources; investigate privacy or security reports; improve content and navigation; measure website use and performance; prevent fraud, spam and abuse; maintain records; enforce website terms; comply with law; and establish, exercise or defend legal claims.
6. Lawful bases
Depending on the activity, processing may be based on your consent, steps taken at your request, performance of an agreement, compliance with a legal obligation, protection of lawful rights and interests, or the legitimate interests of operating, securing and improving an informational website, provided those interests do not override your rights.
Where consent is the basis, you may withdraw it prospectively. Withdrawal does not affect processing already lawfully completed or processing supported by another lawful basis.
7. Cookies and similar technologies
LaborCode.ph may use cookies, local storage, tags and similar technologies for essential operation, preferences, analytics, security and embedded content. The LaborCode Navigator currently uses browser local storage to remember the evidence-checklist items selected on that device. The checklist is not transmitted to LaborCode.ph as case data unless a user separately chooses to send information through a contact channel. The current app does not require an account or upload case documents. Details appear in the Cookies Policy.
8. Analytics and measurement
The website uses Google-related measurement tools through Google Site Kit and Google Tag Manager. These tools may process online identifiers, device information, pages viewed, referral information and interaction events to produce usage and performance reports. The exact data and retention depend on the active configuration and the visitor’s browser or privacy settings.
9. How personal data may be shared
Personal data may be shared only as reasonably necessary with website hosting and infrastructure providers; analytics and performance providers; email and communications services; anti-spam and security providers; professional advisers; contractors supporting the website; government agencies, courts or law-enforcement authorities when required or lawfully requested; and a successor operator in a legitimate reorganization or transfer.
Service providers are expected to process information only for authorized purposes and to apply appropriate safeguards. LaborCode.ph does not sell personal data or provide it to data brokers.
10. International and third-party processing
Some technology providers may store or process data outside the Philippines. Where this occurs, LaborCode.ph remains accountable for transfers under applicable law and uses providers, contractual arrangements and safeguards considered appropriate to the nature and risk of the processing.
11. Retention
Personal data is retained only for as long as reasonably necessary for the stated purpose, website security, recordkeeping, legal compliance or the establishment, exercise or defense of claims. Retention depends on the nature of the information, the reason it was collected, ongoing correspondence, security needs, provider settings, backup cycles and applicable legal requirements.
Contact and correction records may be kept after a response when needed to document editorial decisions or recurring issues. Security records may be retained longer when connected to an incident, investigation or legal obligation. Data that is no longer needed is deleted, anonymized or allowed to expire under applicable system procedures.
12. Security
LaborCode.ph uses reasonable administrative, technical and organizational measures intended to protect personal data against accidental or unlawful loss, alteration, disclosure, access or misuse. No website or transmission method is completely secure. Security concerns should be reported under the Security Policy.
13. Your privacy rights
Subject to the Data Privacy Act of 2012 and applicable exceptions, you may have the right to be informed; access personal data; object to processing; request correction; request erasure, blocking or deletion; withdraw consent; obtain data portability where applicable; claim damages; and file a complaint with the National Privacy Commission.
A request may require reasonable identity verification and enough information to locate the relevant record. We may deny or limit a request where permitted by law, including when necessary to protect another person’s rights, security, privileged material, legal claims or compliance obligations.
14. Children and vulnerable persons
The website is intended for a general audience and does not knowingly seek personal data from children or vulnerable persons. A parent, guardian or authorized representative should contact us if personal data was submitted inappropriately.
15. External links and embedded content
External websites and embedded content may collect information, set cookies or apply their own policies as though you visited them directly. Review the third party’s privacy information before providing data or using its service.
16. Data breaches
LaborCode.ph maintains processes for assessing security incidents and personal-data breaches. Where notification is legally required, we will notify the National Privacy Commission and affected data subjects within the period and manner required by applicable rules, based on the information reasonably available.
17. Changes to this Policy
We may update this Policy when website practices, providers or legal requirements change. The revised version will be posted here with an updated date. Material changes may also be highlighted through the website when appropriate.
18. Contact and complaints
To exercise a privacy right or raise a concern, use the LaborCode.ph contact page and choose Privacy or Security Concern. Include the relevant page, the type of request and enough information for us to identify the record without sending unnecessary sensitive data.
You may also consult or complain to the National Privacy Commission.
